In any case, any of your activity, whether it is for placing orders or even for simple browsing in our online store, binds you with obligations and rights arising from the terms and conditions adopted by Smartshoes.gr. For this reason, you are invited to read the terms of use carefully, to understand their content in full, and, provided that you agree, and only then, to browse our website – smartshoes.gr.

Any corrections, adjustments, or additions to the General Terms of Use, always in accordance with the Laws governing E-commerce, are the responsibility of smartshoes.gr, are entirely at its discretion, and become effective upon their publication on the website, at which point they become effective without prior notice.

2. TYPE AND METHOD OF COLLECTION OF PERSONAL DATA

2.1- The personal data collected and stored by smartshoes.gr are the data such as NAME, SURNAME, HOUSE/OFFICE ADDRESS, PASSWORD. The data subjects voluntarily either a) enter them in the relevant registration forms and account creation of the website www.smartshoes.gr or b) declare during their telephone orders, in order to use the services of the online store.

In addition, information relating to the consumption habits of visitors to the website is automatically collected, with the express consent of the data subjects, through the use of cookies (see in more detail paragraph 22).

3. PURPOSE OF DATA PROCESSING & LEGAL BASIS

3.1- The storage of personal data, voluntarily registered on the website of smartshoes.gr, serves exclusively for the purposes of the internal system for the efficient provision of our professional services ([a] necessary for the performance of distance selling contracts).

3.2-The website is in full compliance with the General Data Protection Regulation (GDPR) 679/2016. In particular, personal data is subject to lawful processing in a transparent manner. [b] Smart Shoes is responsible for processing the personal data collected in the context of operation of its electronic pages, for as long as this is required for the purpose of processing. [c] If you are not satisfied with the use of your data or by our response with regards to your rights, as user of Smart Shoes electronic pages, you are entitled to submit a complaint to the Supervising Authority.

In any case, [d] personal data are collected, processed and possibly transmitted by smartshoes.gr with the express consent of the data subjects, such as – for example  – when using them to send personalized updates for the purpose of marketing strategies or improving the relationship between the online store-consumer/data subject, but also for business analysis purposes.

4. DURATION OF STORAGE

4.1- In accordance with the principle of storage limitation, the online store smartshoes.gr,  stores personal data for the period of time specified by the law regarding the permitted storage periods.

Specifically, [a] when data processing is performed on the basis of a contract, your personal data are stored for as long as necessary for the performance of the contract and for the establishment, exercise, and/or support of legal claims based on the contract and [b] for the purposes of product and service promotion (marketing activities), your personal data are kept until your consent is withdrawn. This can be done by you at any time.

Furthermore, [c] we will retain your account data for as long as you maintain it and have not requested its deletion. Your data that you give us for the purpose of providing you with services, [d] will be retained for as long as necessary to enable us to continue to provide you with those services.

At the same time, it is underlined that any data, which may be subject to the terms for the protection of personal data, is covered by the strong SSL 256-bit encryption algorithm and is stored temporarily, and in no case abusively, on a caching platform with the same encryption method.

In addition to the legal retention periods, personal data is stored for longer periods and for as long as necessary to fulfill a specific processing purpose or to assert, exercise or defend legitimate claims – in particular in accordance with Article 17 para. 3 e) of the General Data Protection Regulation.

5. RIGHTS OF DATA SUBJECTS

You have the right to obtain knowledge of and verify the lawfulness of the processing. Therefore, you have the right to have access to the data and to obtain additional information on the processing.

b) The right to rectification of personal data

c) The right to erasure (“Right to be forgotten”) of personal data

You have the right to request the erasure of your personal data when we process it on the basis of your consent or in order to protect our legitimate interests.

In all other cases (such as, but not limited to, where there is a contract, an obligation to process personal data imposed by law, public interest), this right is subject to specific limitations or does not exist as the case may be.

(d) The right to restrict the processing of personal data

6. DATA SUPPLY CONTRACT

6.1- The consent of the data subject to the disclosure of personal data is necessary for the execution of orders (contracts for the sale of products at a distance) with the online store smartshoes.gr.

NAME, ORDER CODE, PHONE, E-MAIL ADDRESS are stored and registered after the user’s selection – registration exclusively for the processing and completion of the order.

The explicit consent of the data subject is required, of course, upon a clear, distinct and comprehensible request in the following cases: email marketing, newsletters, cookies.

7. CONTRIBUTION OF A CHILD

7.1- The processing of personal data of a child in the context of the offer of an information society service directly to him/her based on consent, is possible when using the services of smartshoes.gr, only if the child who gives consent for this processing is at least sixteen (16) years old.

If the child is under the age of 16, the use of smartshoes.gr services and, by extension, the processing of personal data necessary for the execution of orders is only possible if and to the extent that such consent is given or approved by the person having parental responsibility for the child (Article 8 GDPR).

8. RETENTION OF DATA OF PERSONAL CHARACTER

8.1- Third parties who may become aware of the above personal data, with the express consent of the subjects, in the context of their professional cooperation (employees, marketing-CRM) with the online store, are strictly bound by confidentiality agreements and assignment of processing of personal data under Article 28 of the General Data Protection Regulation.

9. POSSIBILITY OF RECALLING THE RECOMMENDATION

9.1- The data subject reserves the right to withdraw (opt-out) his or her consent to individual or all processing activities at any time.

The processing operations carried out up to the date of withdrawal shall not be affected by the withdrawal. 10. RIGHT OF COMPLAINT TO THE AUTHORITY 10.1 If a data subject considers that the processing of personal data concerning him or her infringes the provisions of the General Data Protection Regulation, he or she has the right to lodge a complaint with the Greek Data Protection Authority (Personal Data Protection Authority), located in Ampelokipi (Athens), at 1-3 Kifissia Street, P.O. 11. E-MAIL MARKETING – NEWSLETTERS

11.1- The online store smartshoes.gr may, with the express consent of the data subjects – customers, send marketing emails – newsletters (to inform customers about new products and offers of the online store and to improve the relationship of customers with the online store).

The specific form of consent must be freely given, specifically informed and clear. These prerequisites are fulfilled when the customers – data subjects have opted to receive marketing e-mails and newsletters (active consent) by indicating that they wish to be informed through them about the products and offers of the online store by filling in the relevant newsletter form available on the website or by responding positively to a clear, distinct, simple and understandable electronic request submitted by the online store.

Rights customers reserve the right to unsubscribe at any time from the mailing list by clicking on the corresponding link in the contact email address.

12. TRADE SECURITY

12.1- Recognizing the importance of reliability in every transaction, the online store smarthoes.gr has developed a secure circuit for the transfer of registered data under the cover of the most impenetrable encryption, securing each entry.

In more detail, the process of clearing your payment, in case you choose Payment by Credit Card, is carried out by Piraeus Bank, for this reason you are automatically transferred to the secure server of the Piraeus Bank.

All your card details (Card Number, Cardholder Name, Expiry Date and 3-digit CVV number on the back of the card) are digitally processed and encrypted in the Bank’s server. Next,  these details are further proceeding from Piraeus Bank to VISA, Electron VISA, MasterCard with an encrypted protocol, which is also covered by the 256-bit SSL encryption algorithm, the strongest encryption available today worldwide.

So the transactions you make at smarthoes.gr via credit cards are completely secure.

13.RETURN POLICY

You can return the product within 14 days from the receipt of your original order, with our partner courier company – General Postal Service.

Returns are free for purchases over 50.00 euros throughout Greece, always by contacting the sales department 22240 23520 (Monday, Wednesday, Friday 11.30 – 21.00 and Tuesday, Thursday, Saturday 11.00 – 14.30).

In case the customer wants to return the product we offer a full refund. Please before any return request call us at +30 22240 23520.

A prerequisite for replacement products is that they must be in their original condition, i.e. not used as well as in their original packaging (inside their box and carrier bag) with their proof of purchase or any other accompanying forms.

In the case of return/exchange, the current prices of the products shall be taken into account. Smart Shoes has every right to change at any time, and without prior notice, the values of the products made available, always in accordance with the E-Commerce Code of Conduct and the Consumer Protection Conditions.

13.2.- Changes to Defects

Smart Shoes during the process of execution of orders, makes a careful control of the products in order to ensure their excellent quality.

If you receive a product with a manufacturing defect, you can contact us either by e-mail at [email protected], or by phone at +30 22240 23520 to make a return/exchange of the product without incurring the costs of exchange/return, in any case.

Smart Shoes processes your return request and instructs the shipping company to pick up your product from the address you have provided. Upon receipt of the returned product, we will contact you directly to complete the replacement process.

13.3- Changes to shipments of incorrect products

Smart Shoes, during the process of executing orders, carries out a thorough inspection of the products in order to ensure their excellent quality and correct shipment.

In the rare case that you receive a product that is different from the product you ordered, you can contact us via e-mail at [email protected], or by phone at +30 22240 23520.

RIGHT OF RETURN

You have the right to return the product you have purchased within 14 days of the dispatch of the product, exercising the right of withdrawal and – only in the event that the product has not been used – to request a refund of the price you have paid to us.

The return costs are borne by the customer & must be paid directly by you to the carrier.

In case the payment of the order has been made through a Replacement Payment, the additional amount charged for the order by the above payment method will not be refunded.

As well as in case the shipping costs have been charged, the amount charged for the order will not be refunded.

14.1 Withdrawal refund procedure:

In the event of a withdrawal, you send the parcel back to us by any carrier you wish at our headquarters in Karistos (96 Sachtouri Street), with your own shipping charges*.

Your parcel must contain the original proof of purchase & a note in which you indicate to us the IBAN account you wish to be refunded, name of the bank and the full details of the bank account holder.

* In case the return is due to an error by Smart Shoes (product manufacturing defect, wrong product shipment) Smart Shoes will bear the return costs.

 

18. METHODS OF PAYMENT

18.1 – Shipments within Greece

The available payment methods that smartshoes.gr offers for purchases through the online store are the following:

181.1- By credit or debit card:

The card is charged through the ePOS Paycenter service of Piraeus Bank and is a completely secure procedure. Supported cards.

The payment clearing process is carried out by Piraeus Bank, ensuring the absolute security of your transactions in our online store smartshoes.gr. Once you complete the completion of the prerequisites for the registration of the order data, you are automatically transferred to the secure server (secure server) in the service of the Bank.

18.2.2.2- Pay by PayPal:

Using PayPal,an online money transfer service,you pay for your order with the most widely used means of secure transactions on the Internet.

The recipient receives only money but never card numbers. Your card details are disclosed exclusively to PayPal, and no genius hacker can intercept your transaction details as they are made up of encrypted pages.

18.2.3- Pay by Repayment

In the case of Replacement, payment is made in cash to the representative of Geniki Tahidromiki’s Courier upon receipt of your products, and the cost is currently (10-10-2021) 2.00 euros.

Banks & Bank Accounts*

If none of the above payment methods are convenient to you, you can pay the total cost of your order by bank deposit. You can pay for your order to any bank via e-banking. Your deposit can be made within 3 business days after completing your order. If payment is not made within this time frame, the order will be cancelled. It is mandatory that the name, surname and order number be indicated in the description box when making payment. Transaction costs are paid by the recipient.

IMPORTANT NOTE: In case you choose to transfer money from a different bank, the transfer costs or any other costs are entirely borne by the customer (you).

The reservation of the products is set at 2 days from the day of the order. In case of cancellation of the order by the customer after it has been accepted by smartshoes.gr, for any reason at all outside of force majeure you need to inform us immediately.

For orders paid by bank transfer please send us the proof of payment by e-mail to [email protected]. Please write the number of your order as a reason on the deposit slip.

 

19. ELECTRONIC DISPUTE RESOLUTION OF DIFFERENCES BETWEEN CONSUMER AND SUPPLIER

According to the legislation CPR 70330/2015, Directive 2013/11/EC provides for the possibility of electronic resolution of consumer disputes through the Alternative Dispute Resolution procedure (http://ec.europa.eu/consumers/odr/index_en.htm), which operates as an out-of-court settlement of disputes between consumers and suppliers, on line, quickly and at low (compared to the courts) cost and is completed electronically.

The ADR (Alternative Dispute Resolution) body must make a decision within 90 days. Before making a request to the ADR body, the consumer must have previously contacted the supplier and sought to resolve the dispute directly with the supplier.

The supplier will then propose the relevant ADR entities to resolve the dispute. If there is a successful settlement a record of conciliation will be drawn up, otherwise a record of failure will be drawn up by the body and if it wishes it will continue the proceedings in the courts. This procedure serves all EU countries.

It is expressly prohibited any copying, reproduction, republication, trademarks, logos, banners, layouts, interfaces, graphic designs, advertising or promotional activities, or modification, modification, alteration, counterfeiting, copying in part or in whole or in any other way infringing the intellectual property rights for the works appearing on this website without the express, written consent of the company.

Violation of any of these provisions is expressly prohibited by law, and may result in severe civil and criminal penalties.
